Ordinance(s)/Regulation(s) and Brief Description:

Merchant Shipping (Safety) Ordinance (Cap 369) consolidates and amends the law relating to the safety of merchant shipping and for purposes connected therewith. In addition, the following ordinances are also relating to other aspects of shipping safety:


Conformity Assessment Mechanism:

Pre-market approval:

Ships are required to operate with the relevant certificates and inspected for conformance of the relevant legislation before enter into service.

Post-market examination:

Ships in operation are required to be inspected periodically to confirm the ship is maintained to the required standards. Under the Merchant Shipping (Safety)(Safety Management) Regulation the management standards of the ships and their operators will be audited periodically. Inspections may be carried out either by Marine Department surveyors or by the surveyors of a Certifying Authority recognised by Marine Department. When a ship in service is reported to Marine Department by the Administration of another country as being defective or not complying with the necessary standards and safety requirements, Marine Department surveyors or its authorised surveyors will attend the ship to ascertain the situation and, if necessary, provide advice to the ship master to rectify defects.
