Ordinance(s)/Regulation(s) and Brief Description:

The Road Traffic Ordinance (Cap 374) and its subsidiary regulations govern the transport-related matters to maintain a transport system which is safe, reliable, efficient, environmentally friendly and satisfying to both users and operators. The Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374A) stipulate specific requirements on vehicles and their parts, while the Road Traffic (Safety Equipment) Regulations (Cap 374F) set out lists of accepted international standards for protective helmets, seat belts, anchorage points and restraining devices for children. The Specification of Safety Glass Notice (Cap 374H) includes a list of standards for safety glass of vehicles.

Conformity Assessment Mechanism:

Pre-market type approval, registration and licensing:

The first of a new make and model of a completed or incomplete vehicle imported for sale by the authorised agent/distributor and all buses are subject to type approval. A Type Approval Certificate will be issued if the vehicle passes the examination. Subsequently sample vehicles of type approval models will be randomly selected for conformity test yearly until the models cease production.

Parallel import vehicles by individuals and type approval vehicles involving post-approval modification are required to be presented for a pre-registration examination. Vehicles and buses passing the pre-registration examination will be issued a Certification of Roadworthiness (COR) or a Certificate of Fitness (COF), whichever is appropriate. After the issue of the certificates, registration and licensing is required.

Post-market surveillance:

A new COR or COF will be required for re-licensing, according to the time schedules for different categories of vehicles.
